    Over means test, but still ch.7???

    Been basing my ch.7 filing date on my average 6-month income (which will include at least a few months of unemployment $$$). Now I have a question since I've been reading that there are a couple parts to the means test.

    Can I be over the threshold, which is something like $43,000 and some change for a single person in michigan, and still file chapter 7 if my expenses leave me with less than $100-200/month disposable income???

      Yes, I was $21k over the median and was still able to file a ch 7. It's all about your numbers, make sure you expenses are allowable under the IRS Guidelines. You may exceed some of the catagories, but you will need to have proof of these expenses.
      May 2008 Hired 1st Attorney/Stopped paying CCs
      May 21, 2009 Retained 2nd Attorney
      May 28th - Filed for Ch 7 (FINALLY!)
      9/11/09 - DISCHARGED!!!!
