    Judgements before filing

    I just received a summons from Chase. I have 20 days from today to appear. Is that business days?
    I am filing Ch 7 25 calendar days from today. What should I do?

    I had notified my human resources dept. at my job that I was about to file bankruptcy and not to honor an upcoming judgement. They agreed. You might want to try that.

      Just curious how long you had "not paid" before Chase filed against you?

            I stopped paying Chase in May of 2009.

              From your description, sounds like you've been served (requested to appear in court), but that does not mean a judgement has been recorded against you yet.

                  From my experience with credit card judgements (my husband had 3 of them Citi, Wells Fargo and Household Finance).In the town wherewe live, we are able to log into our court system and view public records. I had noticed within 1 month of judgement, they asked the court for a writ of execution, and one of the creditors (Citi) went to my husbands bank (the one he would write the payments from) and attached the money there. Luckly there was only $50 in there so that is all the got. We filed the BK within one month of that because the next step they were likely to do was to attach is payroll or put a lien on our house and so by that afternoon, our attorneys office had faxed letters to all the creditors and their attorneys advising them we filed BK chap 7. I think closely monitored those 3 judgements and had noticed one of them had went down and obtained a writ, I phoned my attorney and they immedically contacted them and told them it was illegal and had 10 days to withdraw the writ. Which they did.

                    Just curious, was the amount of the debt under $5k? I defaulted on Chase with $27k for over a year and was never sued. One of the Moderaters here said that CCs tend to go after debts that are under $5k because they are easier to collect (don't know why...).

                      The 3 my husband had were 17k, 1500, 10k. All the little cc card companies never did anything except charged off.
