You do not include SS on the means test but you do include on Schedule I.
Filed Ch7 5/28/09 (Pro Se) Orlando, 341 7/01, UST selected case for audit 7/01, Last day for objection 8/31. Audit report filed 9/10, no material misstatements. Discharged and closed 9/22/2009

AJ007 is correct. You *do not* include Social Security income on the Means Test. You *do* include it on Schedule I. (Completely goofy, I know. Thanks a bunch for writing this really bad law and then worse, passing it overwhelmingly, 2005 US House and Senate.)
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

Once included on Schedule I, it does depend how it is handled as to the district, state, and trustee's take on that bad law on how social security income should be applied in this case. We are walking testimony of what I just said. But, it truly depends on the individual's income and expenses, and much more.
            (first 341 10/14/09, cont'd 341 10/23/09) (12/14/09 last day to object) (341 Shows HELD w/tt report of no distribution 1/9/2010)

We are a plus $481 on our schedule I and J with our Social Security included. Nothing was mentioned at the 341. Our attorney said it shouldn't be a problem. We are 40 days into the 60 on our ch. 7 and so far he is right. Keeping my fingers crossed.
