How long to hear from Trustee about tax refund

Our tax refund will be exempt up to $2K. We are getting back about 2300. The attorney said he might want the extra, he might not. I sent a copy of our tax return last week, as instructed by the attorney. How long should it be to hear back? Should I just put the other 300 in savings and forget about it? does he have a certain amount of time to claim it? If he does want it, will he just ask for us to mail him a check?
