    Chapter 7 an car problem

    Ok.... I just have my 341 meeting a couple of weeks ago, I had a vehicle that I leased and I ended up turning it in. I noticed that it was not added to the schedule as an assets since my mom purchased this before BK. My mom did this since, I will be without a car and I need my car for my job. Now I received a notice stating a turnover of title and keys. I am totally freaking out since I don't live in the area anymore and I may lose my job without having a car. What do I do, is it too late to get an attorney now since I already attended my 341 meeting. This is the only car I have and without it I have no transportation I already show the trustee all of the documents that prove my mother took it out of her account and everything.

    If it isn't in your name then how can they try to to claim it? Is it registered to you?

      Yes, the title is in my name... We didnt think to add in my mother name since, she had all the paperwork showing the money was taking out of her account.

        I live in FL and the trustee mentioned that FL is a title state but we didnt want to run into a risk of getting in trouble with the police.

          How much is the car worth? What is the exemption for vehicles in your state? The fact you didn't list it and it is in your name could be detrimental to your filing. You may want to seek the advice of an attorney.

            so does i will lose the car the car is only worth 4,000 and I am in the state of FL. Can I transfer the title to my mother name or is it too late to do that as well.

              I also have paperwork, bank statements (mines and hers) and letter notarizing mentioning about the purchase of this car.

                You have already had your 341, so you *might* be okay to transfer, but I wouldn't take the risk. Just sit tight until you are discharged.

                  I just recieved a letter stating I have a "Trustee motion for order requiring appearance under rule 2004" And a notice of "Turnover of property" for this car. This is even after showing the trustee all of the paperwork proving that there is no way I could afford this car.... I am so nervous I don't know what to do anymore.... or afford to do....

                    If the title is in your name then it is your asset regardless of who made the payments. You will have to exempt the car or the trustee will consider it a sellable asset. You will be allowed to buy the asset back from the trustee however.
