My spouse will be filing Ch7 next month.
We have been divorced since Aug 09.

1]Should he list my cc debts on his filing because we are in a community property state?

2] We are both named on the title to a car which is 27K
Should he list this debt? since it is listed on the title as "or"
and I received this car in the divorce?

3] will my cc debt be discharged in his filing?

Your Ex-hubby will be "relieved" of all responsibility of this debt. He should list ALL his debts in the petition (his attorney will know how to list it in the petition), but you will still be liable for the debt/car. Once he's discharged, any loans/debts that were in BOTH your names will shift to you. No, your credit card debt will not be discharged.
