In my case, trustee told the whole group the 09 refund is property of the trustee. I will be e-filing but requesting a physical check refund from both fed and state. I will mail a paper copy of both returns to the trustee. Hopefully, I hear from the trustee what he wants before actually getting the paper check (or unless the paper check gets sent to the trustee directly.. I have no idea what will happen).

We told the trustee that we needed to make amendments at our 341 to adjust our expenses so that we could reaffirm on a vehicle loan. He was fine with it and it did not impact the timing.

However, changing exemptions may be a different matter. I'd make the amendments before the 341 and point it out to the trustee at the 341. As long as you have the room and aren't trying to slip one by should be no problem.

My trustee said he wanted copies of our fed and state tax returns and to not spend our refunds until he had made his decision. This was in Utah. My lawyer said the trustee is entitled to 10/12ths of my tax refund because of my filing date.

If you want to make sure that your return is protected, then you have to exempt it. This would require you amending your return. I am not sure if it would push back your 341 date, as long as your lawyer could get the return amended in time to get it to the trustee for review before your 341.

When we initially filed we were in a 13. We had our refund direct deposited and then we had to write a check out to the trustee for it.
