    Question about student loan and BK

    So we filed and was discharged from BK7 in December of 09.

    My wife had two student loans from two different places for about 10k each total. We thought both were federal so we did not include them in the BK since we know they are not dis chargeable.

    Well today I check my wifes credit report and one of the loans is reporting as IIB. So I recheck the paperwork and it was a private loan which is a good thing, meaning we are not legally responsible for that 10k since it was IIB. However I sent them a payment of $150 Feb 1st. My question is what will they do with this payment and will it in anyway make me liable for the debt in the future since I made a payment after the discharge?

    Let me modify my statement. I am not sure this was a private loan or not, but it is reporting as IIB on her EQ and TU report. Her other student loan is not.

      I wrote this post for a reason.



      It might be an error on the credit report. Sending the $150 will not make you any more or less liable for the debt.
      So the poor debtor, seeing naught around him
      Yet feels the narrow limits that impound him
      Grieves at his debt and studies to evade it
      And finds at last he might as well have paid it.

        Private student loans used for tuition and expenses at a qualified educational institution are not dischargable in bankruptcy anymore as of the 2005 laws. But - if the Dept of Education doesn't recognize your wife's school as an 'eligible educational institution' then it could be a dischargable loan.

          That's true.

          There are also a few other extraordinary rare situations where a student loan can be discharged, such as if the loan was made for an amount over the cost of attendance.

          But 9999/1000 it's a non dischargable student loan.
          So the poor debtor, seeing naught around him
