    tax refund/trustee ?

    I filed chp 7 August 2009. Attorney says the trustee can take my tax refund up to $750. Is this taxes for last year or can they take my refund I get this year? I was just discharged in December....I really could use my refund if I get one. How does this work?

    Sounds like the trustee wants the 2009, which is what you are probably about to file. I am in the same situation. I am exempt up to $2k.

      I agree it sounds like he's wanting your 09 refund.
      4/09 Converted to a Ch 7 due to loss in dh's income
      5/09 UST now involved no idea what happens next
      7/09 UST has decided to withdraw his motion to dismiss!
      7/27/09 DISCHARGED!!!

        From what you wrote, the trustee wants up to $750 of your 2009 refund. The way it would work is that you would file your taxes, get your refund, and then pay the trustee a certain percentage of it. Were you made an asset case?

          Why would a trustee want up to $750? Wouldn't it seem more likely a trustee would want anything over $750?

            My trustee said "send a copy and I will tell you what you owe"....lol

              I had a copy of my fed and state returns for 2009 at my 341 today, TT said I can keep my refund, cash it and do what I want with it..

                Maybe everything is exempt but the $750.

                  I am simply quoting the OP in regards to wanting "up to" $750. I agree with you OF that the trustee would most likely want anything over a certain exempt amount, in this case, $750.
