    Almost set to go...

    ...we're just waiting for our tax return and then we'll have our green light.

    I found an awesome attorney, at least so far he seems really good. I'm hoping he turns out to be as good as we think he'll be. He was the most open and down to earth out of the ten or so attorneys that I interviewed. He knew his stuff, didn't say anything contradictory to what I've learned here. He said he felt absolutely confident that ours was an open and shut case.

    I've been worried that us filing so close to the eight year mark of our last bk would be an issue but he explained, very thoroughly, that our area is experiencing a high rate of bk and has been for a few years now. I live in the heart of the steel manufacturing industry and he said this area has been hit really hard. He went on to say that repeat filers in our area are almost common place in this area right now so it wouldn't be an issue.

    As an FYI for anyone filing in the Hammond district of Northwestern Indiana what I've found is that most bk attorneys here charge between $900 and $1K for a simple chapter 7. One attorney quoted me $1500 but I believe it's because she does bk on the side so it takes her more time and effort to file a bk because she doesn't have as much experience.

    I haven't put a retainer down but our attorney knows our refund is due to arrive shortly and he'll be paid in full at that time. He gave us the green light to go ahead and refer creditors to his office.

    I think my kids will miss all the calls. Every time a creditor called from a new number I'd program that number into my phone and assigned the same ring tone to all of them. On caller Id they'd show up as Jerk One or (I have over ten Jerks in my phone) Shite Head. Every time the phone rang with that "special" tone the kids would want to know who it was this time. I turned it into a game and they got a big kick out of it. The older two are old enough to understand. I over heard my oldest on the phone with one of her friends one night explaining that the other call coming in was from Bunghole. Our family has a raunchy sense of humor.

    Anyway- I'm sooooo looking forward to getting this ball rolling!

    Yeah! Congrats on getting the BK ball rolling....

    9/11/09 - DISCHARGED!!!!

      Thank you liz.

      This weekend hubby and I will do the credit counseling online and get that faxed to our attorney. I'm just hoping it's something that we can push "pause" on if we need to. The kids always seem to suddenly need us for stuff when we're trying to get something done.

        That would be like a contractor explaining he rarely remodels kitchens so he has to charge you more because it will take him longer than an experienced contractor.
        Well, I did. Every one of 'em. Mostly I remember the last one. The wild finish. A guy standing on a station platform in the rain with a comical look in his face because his insides have been kicked out. -Rick

          I agree. Granted she didn't come out and tell me that she doesn't have as much experience, that's something I figured out on my own. I went to my courts website and looked at the schedule of 341's for a 4 week period and she had not one case appearing anywhere during that time. Out of all the attorney's I interviewed she was the only one that didn't show up on that list. I figured that probably wasn't such a good sign. Especially when she wanted the most fee wise.

          Good thing she's not a dentist!

            I'd like to ask anyone who may know...what happens now? I told all of my creditors yesterday about our up coming bk and the calls have stopped but I'm wondering what happens now on their end? We're only six weeks or so from filing so I'm wondering if our creditors will even bother sending us to collections at this point.
