I expect to file chapter 7 in a few weeks. It looks like my 2009 income tax situation is as follows:I owe the IRS up to $2000(due to premature IRA withdrawals as well as losing the child tax credit for one of my children) but am due a refund from New York State of about $700. If I receive that money after I file is the chapter 7 trustee likely to take that money since I owe taxes to the IRS? Any information on this topic would be greatly appreciated.

The way i understand it, is that you wont even see the refund from the irs. they will automaticly apply it to what you owe them. -
To clarify. I am NOT due a refund from the IRS. I AM do a refund for state income taxes from the New York State Department of Taxation and Finance for STATE income taxes.Comment
