    Another tax question....sorry..

    60 days will be up in 7 days. No asset case. No objections as of yet. Surrendered home in bk, but I did make payments for 6 months last year prior to filing bk. in October. I still own the property and it has not sold as of yet but it is in active foreclosure process. Mortgage company (CCO Mortgage) sent letter stating they have opted to NOT pay taxes or insurance on property as of 2-1-10. Property taxes are paid in full and not due again until summer. Trustee said nothing about wanting copies of tax return and still has not. I did exempt my "hopeful" return in my bk exemptions. Have not received any 1099's from any creditors or mortgage co. as of yet.

    Can I file right after discharge? Is the interest I paid on the 6 mortgage payments deductible since it was paid prior to discharge? I do plan to hire a professional CPA to help me out but wanted to get some advice before I pay them so I am somewhat educated on this and not taken for a ride by a pricey CPA.

    If you have an exemption to cover the tax refund, then you don't have an issue.

    You can file your taxes at any time. And yes, you can deduct any mortgage interest you actually paid.
