    Insurance Deductable

    I need some opinions as to weather or not I'm thinking correctly or not.

    I had a liver transplant last year and because of that I will ALWAYS have high medical cost including deductibles. My current deductible is $3000 and will likely change to $5000 next renewal. After my deductible is met my medicines are paid 100%.

    My thought's are that I should be allowed to claim $250/month ($250 X 12=$3000) as a monthly expense. The lawyer said that I couldn't claim it. No explanation as to why, just that we can't claim it.

    These med's are a medical necessity, as my body will reject the new liver and I will again go into liver failure.

    After I got home, I got to thinking about it and just can't believe this isn't an allowable expense, and that maybe the attorney misunderstood my explanation of these cost.

    What say ye of more knowledge?

    I'm no expert either, but maybe the attorney thought you wanted to just claim the deductible amount with no reason. You should be able to claim your actual medical expenses, but if they are high you will likely have to have proof. As long as you have proof of what you have paid, I don't know why it wouldn't be allowed.

      Blueboy, I would consult another attorney asap. Quality of life and medical necessity should be allowed. My son has a heart transplant so I really feel for you and hope you get this to work in your favor.

        Claim the actual expense, not the deductible. You should have receipts proving the costs of the medicines.
