I'm meeting with our attorney again next week to ask this question, but thought I'd ask here first..
My husband and I originally planned to file chapter 7 together in late June/early July b/c I filed ch7 in June 2002. I only have about 10K unsecured debt and that is a repo from 2004 (long story) and 17K in student loans that can't be discharged anyway.
We're now thinking maybe it would just make more sense for my husband to go ahead and file alone since all the rest is in his name... but what is affected (or is it effected)?
For instance, does filing alone vs. filing together only change the exemptions we are allowed (like 35K homestead rather than 70K)? In a family size of 7 with no other income except my husband, do we still get to claim all the same expenses?
