    Selling a financed vehicle before discharge?

    We have a financed vehicle with about $4500 equity in it. We just had our 341 meeting and the trustee said it falls under our 5K exemption so not interested in it. We have decided to sell the car to Carmax and take the $4500 and buy a clean old car to eliminate car payment.

    Here is the problem...Carmax says they cannot take the car on trade until the bankruptcy is discharged. Anyone ever heard of this? If it matters the loan is with Chase and we have not reaffirmed the loan and are simply doing a ride through.

    Even though it's exempt, the car is still part of the bk estate until, you're discharged.
    CArmax-like many businesses want nothing to do with an open bk. Just be patient and wait on your discharge.

      Problem is I have to keep making the payments which are hard. Thanks for the advice.
