    Filing soon, attorney is concerned

    I spoke to my attorney today after he reviewed my information and he raised two concerns which I did not expect...

    - He wants me to file '09 returns within 2 weeks. I had no intention of doing so until April. His point is that I made too much money the past couple of years and it would look suspicious to have my income fall off a cliff in '09. Which it did! He wants to file with '09 returns only, and hope that prior years will not be requested.

    - I received loans (gifts) from family to help me pay the necessities these past few months. He claims that this may well be viewed by the trustee as income?! How can that be?

    Thoughts?

    Filing with 09 returns only? I'm not so sure that's going to fly. I had to file with 4 years of returns being provided.

      Hopefully the lawyer is familiar with local practices. I only had to provide my 2008 taxes, no interest from the trustee in 2007 or 2009. Just so long as you guys are ready for the possibility that the trustee may indeed show interest and have a contingency plan for that, even if you're trying to minimize that possibility.
