    My chapter 7 will be filed 01-28-10 - My car is junk, what do I do ?

    Ok I signed all the documents for my chapter 7 tuesday the 25th and my lawyer said he will have it filed by the 28th, which is friday. Im not to worried about any problems with the bk since I have no assets BUT ... my 1996 Explorer is a total rag. I am not sure it will make it till discharge date. Does anyone know of or had any dealings with auto loans after the 341 hearing ? I have heard they exist.

    Welcome to the forum! The 28th is this Thursday, not Friday by the way As for auto loans, they do exist after having the 341 meeting. Is your Explorer covered by exemption? If you are considering getting a car, I would suggest getting an inexpensive reliable used car to use after your 341.
    Maybe to pay in cash instead of financing through an auto loan until you are ready for a newer car with financing, but it is possible to get auto loans after your 341. Loan terms might be not be very favorable, but not denied. Good luck!

      If you intend to finance a new ride, you better do it prior to filing.
      I doubt a lender will touch you until you're discharged .

        We are currently not paying on credit cards, most are 2 or 3 months behind. My wife tried to get a car loan and they denied her due to not being up-to-date with the CCs.

        Just sharing our experience....
