Just when you think you're done with your ex... he rears his head.
A few months ago, my former spouse calls out of the blue to tell me I am possibly entitled to a portion of his retirement (It's some sort of non-conributory pension plan I knew NOTHING about when I drew up the divorce papers and QDRO - as you can see, we were not close). He gave me a phone number to call, which I did and they told me to send them a request to receive my share. I did that. But I heard nothing from them. He called a few weeks later to ask about it and insisted I had a share and that I should call them again. I did so. They informed me I did NOT have a share and there was no mention of the retirement in the QDRO I filed. I looked for my copy and sure enought, it does not specify any retirement/pension funds - only the 401K which I received many years ago. So, I forgot about it.
Until HE called again this morning and insists I do have a portion, because they are holding my portion and only giving him a smaller portion. (Gawd, leave me alone already!)
My question is - if there is a small chance he is right - will this pension business screw up my Chapter 7? Can they MAKE me take the money? As poor as I am, I just don't want to have any more to do with that man... But more importantly - will pension funds from my former husband's company, mess up my already filed Chapter 7????
