    Luxury item?

    Is a laptop computer a legit purchase? A cheap one (less than $400), or would this raise an eyebrow by a trustee?

    It could be very legit. I wouldn't think that a less than $400.00 computer would raise any eyebrows.

      Only $400 for a laptop computer raises my eyebrow.
      Well, I did. Every one of 'em. Mostly I remember the last one. The wild finish. A guy standing on a station platform in the rain with a comical look in his face because his insides have been kicked out. -Rick

        Not for one of the net-books. That is a very reasonable price. And even full sized laptops can be found for around $600-$700 with rebates and discount coupons.

          Got a sale flyer from Staples yesterday selling a Compaq laptop for 399.98. 15.6" screen, 3 gb ram, 250 gb hard drive.

          They are getting cheaper every day........

            I get a 'weekly special' email from Staples, and there is a similar special in it for this week.

              $400 is the average price for a netbook.

                Even if you assume that it is a luxury item, the presumption of non-dischargeability doesn't arise until you get to $550.

                (C)
                (i) for purposes of subparagraph (A)—
                (I) consumer debts owed to a single creditor and aggregating more than $550 for luxury goods or services incurred by an individual debtor on or within 90 days before the order for relief under this title are presumed to be nondischargeable;
                And from a practical standpoint, it would not be at all cost effective for a credit card company or a trustee to bring an adversary proceeding to have the charge held to be non-dischargeable. So I wouldn't lose too much sleep over it.
                Pay no attention to anything I post. I graduated last in my class from a fly-by-night law school that no longer exists; I never studied or went to class; and I only post on internet forums when I'm too drunk to crawl away from the computer.

                  Thanks for the replys,I wasn't going to charge it anyways.I am surrendering my home and my attorney said not to pay on it anymore. I know I can't have much cash at the time I file so I have to spend it somewhere and my desk top is about 6 years old and starting to freeze now and then.Also when I move I doubt i'll have as much space in my dwelling as I do now so a laptop would be down sizing.

                    Some of us old people don't know what a netbook is.
