Our charitable contributions were kinda of questioned at first but we provided copies of the last 4 years tax returns with copies from our church that are end of year donations printouts proving that we have tithed and given offerings. Our attorney asked the UST if they wanted more as my wife keeps the tax returns for 10 years and we can go back that far. The response was no, they were satisfied we were not defrauding or attempting to.

Our attorney used the national standard numbers ($60\person) on line 19b for 2 people in the household. He also put our monthly premiums that are from bi-weekly payroll deductions on line 34 a\b\c. I thought that was listing the same expense twice, but I am not the attorney.

      Have you had attorney consults?

I spoke to an attorney over the phone but thats it. From everything I explained to him he said I would be an easy Chapter 7, but I think he didnt take into account that I do not have a car payment at this point, although I do plan to get a used truck with my first time home buyer credit and finance about $1500 over a year or two.

They should typically be forward-looking, though. That's why the numbers are often different to the six-month lookback on the means test. It probably depends on the district, but reasonable and necessary things beyond recent actual expenses can be entirely defensible. If you filed bankruptcy because how much you had left over each month was horribly insufficient even by the IRS standards (for instance, my kids are well overdue for medical checkups now, our car was well overdue for maintenance, and my best boots when I filed had big cracks that let the water in!) then it can be okay to file Schedule J expenses that, while they reflect honest good-faith intentions, are higher than what you've recently spent.

I agree but forward thinking tithing without verifiable prior contribution should be a no no.
Well, I did. Every one of 'em. Mostly I remember the last one. The wild finish. A guy standing on a station platform in the rain with a comical look in his face because his insides have been kicked out. -Rick
