I was thinking you could fight with the "little bank", but your State's underlying non-bankruptcy law would play a big part. If your attorney thinks it's a non-starter, then it is.

also how are they going to get a judge to relive the stay when I am current? This just isn't sitting well with me

Doesn't matter about Relief from the Automatic Stay. The Automatic Stay disappears after discharge. It's not a permanent thing.
