    Leased Vehicles - Foreign Debt

    New to this, so hopefully I am not asking questions already answered. I'm thinking of filing chapter 7 and have 2 leased vehicles. I would like to keep them. One is mine and one for my son who is graduating college this semester. Is this allowed? Also, I have debts in Canada and would like to include those as well. Does anyone know if this is possible? According to an attorney in Canada, since I no longer live there, I can not file in Canada but need to from here. I've heard conflicting information from my attorney in US. Thanks.

    i just got discharged, and I included over 30K in canadian debts on my list of creditors. No biggie from my US atty
    2009-Jan: Retained Atty
    2009-Oct: Filed Ch7
    2009-Nov: 341 held
    2010-Jan: Discharged on Pacer

      You can certainly include your debts from Canada; it's okay to put foreign addresses on the creditor matrix. I also included foreign debt on mine.

      I suspect that only protects you from proceedings in US courts, though. If you are worried about being pursued through Canadian courts, if you have any income from or assets in Canada, then you may have to apply under their Bankruptcy and Insolvency Act for recognition of the US proceeding as the foreign main proceeding. I don't know if that's something debtors can do, and if the discharge you're looking for would thus be granted in Canada too. I'd be interested to find out, though!
