    Chase filing suit... Are we ok?

    Hi,

    Gotta letter last week from Chase Legal saying they were filing a lawsuit against us for non-payment. Our attorney instructed us to mail them a Creditor Letter stating our intention to file Chapter 7, which I did on Friday.

    The other night while I was at work, my wife said a large guy in sweats came to our door knocking loudly and continually for five minutes until he finally gave up and left. Must've scared her a bit. Could Chase be serving us this quickly?
    If so, will the letter we sent them have any bearing on the lawsuit or their intentions? We're about two weeks away from filing.

    It's possible, but in our area, anyone serving papers is either wearing a badge/gun or a suit/tie.

      I had a Chase account that I stopped paying for over a year (24k) and never was sued. I got lots of "threats of lawsuits" and a few knocks on the door (looking back, it was probably just door to door sales ). When did you stop paying Chase and when do you intend on filing for BK? Even if you get served, you still have a little time to file. Don't worry until it actually happens. Good Luck!
      May 2008 Hired 1st Attorney/Stopped paying CCs
      May 21, 2009 Retained 2nd Attorney
      May 28th - Filed for Ch 7 (FINALLY!)
      9/11/09 - DISCHARGED!!!!

        Funny how the door knocks seem the worse in bankruptcy ahahha
        I open door now and if some idiot is there I dont want I ask them to leave
        or I open can of Whoop Butt Your house not Chase House.... I feel my home is
        my home not going to let anyone intimidate me!

            LOL!!! I'm not as brave as you (nor am I as big as you either! ), I just peeked out the windows and pretended I wasn't home, but I'm sure they heard the TV on, dogs barking, car in the drive way, etc.

              We stopped paying our creditors 5 months ago and started a BK fund. We were going to file on the 18th but ran short. Now we're looking at 2-3 weeks. Chase has sent two letters... one threatening a lawsuit and one from Chase Legal saying they've been instructed to file one (though the last paragraph offers a contact number for repayment options). Our total debt to them is 15k. I'm in CA and their legal offices are only 45 miles from us. At least if they did file they wouldn't have to travel that far.

                A letter saying you are intending to file bankruptcy will not stop Chase from suing you until you actually file bankruptcy.

                Some creditors will see that letter to hurry up the process, and some will see that letter and figure suing is not worth their time and money. A lot of people threaten to file bankruptcy that never actually do.

                Until you actually file, you may have people pounding on your door trying to serve you papers. YMMV.

                  I don't know if it helped to slow things down or not but I'd always reply to that kind of letter a couple of weeks later, starting by asking for verification of the debt, and then in later replies asking about payment plans and settlement offers and suchlike. None of our unsecured debtors got as far as filing suit before we filed for bankruptcy.

                    The letter (dated Dec. 4th) was part of our packet from the attorney's office. It states that they are representing us in Chapter 7 and asks that they call them regarding the filing date. We're about 40k underwater... a third of it owed to Chase. I've heard they're pretty aggressive so we may indeed be sued.

                    As far as offers, we'll see... but I doubt we'll be interested. Should we be? ..despite already taking the BK this far?
