    who checks up on credit counseling?

    At the end of December I went through the US Trustee's site to find a court-approved credit counselor for the Northern District of Illinois, did the counseling online, and received the certificates and submitted them with our filing on Friday.

    The bankruptcy clerk gave me a small packet of general informational stuff which includes a list of accepted credit counselors and ours (Abacus) is not on there. So now I'm freaking out as to whether someone somewhere is going to have a problem with Abacus and tell us our credit counseling was invalid.

    But I don't even know who to ask about this. Who is responsible for checking the credit counselor (as in checking that who is on the form is approved)? The trustee, the judge, the clerk, the lawyer?

    Our certificate clearly states that Abacus is approved for our district, but since it's Abacus itself saying that, I'm a little nervous about trusting it.

    The list of approved counselors the clerk gave me is very unofficial looking. No seal, no signature, not on letterhead of any sort, nor does it have any dates on it, let alone a "last updated" date. I would think I couldn't be legally held to it, but I just want to be sure I'm covered.

    I'm finding it difficult to believe that some actual person checks every certificate submitted against a list somewhere, but who knows.

    I wouldn't worry about it too much. Whatever the clerk gave you as the list. Most BK court websites will have a page that lists the approved providers for the course. The process for approval is fairly streamlined and

    I would have to go back and check, but I believe the U.S. Trustee's office is responsible for approving the Consumer Credit Counseling firms for the course. I bet you are correct, I doubt anyone at the court crosschecks the CCCert to see if you used an approved provider.
