    Medical Bills Question

    We are not yet discharged (probably February). I have two medical practices that were included in the bk that are still sending me monthly bills. I do not have any immediate plans to pay them, but I have not yet contacted them about the continuing bills either. One of them is pretty much the same as the ones that were sent pre-bk. However, the one that is concerning is the other one, which is now addressed to my daughter rather than myself. She is not yet a year old. I do not know what, if anything, they can do in this situation. Surely they cannot take collection action against my child???

    Thanks in advance. It is late and I may not be thinking rationally.......but I hate to harm my children in any way in this situation (I hated when I had to even 'mention' them on the petition, even if their names weren't on it).

    Did you include them on the creditor matrix?

    Are the bills they are attempting to collect pre filing date?

    If so they are violating the stay issued by the court and you should inform your lawyer. I don't see how a 1 year old could be held accountable.

    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.

      They were included on the matrix. I filed pro se.

      Yes these were all bills that were incurred prior to the filing. We fortunately have not needed to visit the doctor since we filed, except for a well baby visit which was covered by my insurance at 100%.

        Okay they could be taking advantage of you since your pro se.

        I would call the contact number given in the paperwork. Then give the person your bankruptcy district filed, chapter filed, date filed, and case #. Inform them that they are in violation of the stay having continued to mail out bills and that you are well aware that they are in violation. Then tell them that if they continue to violate the stay you will have no choice but to seek legal recourse.

        Take down the name of the person you talk to and the date and time. Keep all bills/correspondence they send.

          No they can't do anything. But you should contact them with all your BK info and get the name of you talk to. They are in violation and you should tell them that.
          4/09 Converted to a Ch 7 due to loss in dh's income
          5/09 UST now involved no idea what happens next
          7/09 UST has decided to withdraw his motion to dismiss!
          7/27/09 DISCHARGED!!!
