    Chap 7 filing: must include list of debts not intended for discharge?

    My Chap. 7 filing date is approaching. I know that the papers filed in court must include a list of creditors whose charges I want discharged. However, in addition to those creditors (CC banks), I have a few smaller creditors, such as small medical bills, that I intend to pay on my own. I'm not asking to have the small medical bills discharged.

    My question is: does my Chap. 7 filing have to include a list of ALL my debts -- even the small medical bills I intend to pay myself?

    I've heard that the US trustee could throw the filing out of court if the filing doesn't include ALL debts, including bills the debtor doesn't intend to discharge.

    I don't want this thrown out because of a technicality. Thanks.

    Mine did, everyone I owe is listed.

    I called those who I am going to reafirm with, let them know, gave them the case number.

      It is my understanding that you cannot pick and choose who to list, yes you must list them all. If you want to pay them however, no one will stop you

        The TT will ask you at your 341, under oath, if you have listed all of your debts. Not worth the chance to have your case dismissed.
        Filed Ch7 5/28/09 (Pro Se) Orlando, 341 7/01, UST selected case for audit 7/01, Last day for objection 8/31. Audit report filed 9/10, no material misstatements. Discharged and closed 9/22/2009

          You MUST list all of your debts--even the small ones you wish to pay on. Once you get your Discharge Order, on the back of it will be a list of the types of debts that are discharged, the types that are not discharged, etc. There will also be a statement under the "not discharged" category to the effect of "any debts that the debtor voluntarily wishes to repay."

            List them all. Just because you list them doesn't mean that you can't pay them!
