    Chase bank!!! Not able to talke to b/k department!!!

    Is anyone else going through this? Surrendered house almost a year ago. Left house, filed b/k, discharged 11/09.. Problem is, still receiving mortgage statements and cannot get through to Chase's bankruptcy department. Every time ( and we have been trying a lot ) the customer service people transfer and the recording either says too busy try again or leave a message and NO one has called us back.. Really disturbing because the HOA still bugs us also until the deed is transferred. Any advice from anyone how to handle this??!?!?

    You are responsible for HOA payments after your filing date until the property is officially transferred into the banks name.

    If you are looking to see when that will happen, contact the foreclosure attorney that is handling your case to find out when the sale will occur. They may not know - they may something like 'we are waiting for the hearing to set a sale date'. Once you are discharged you do not need to speak to the BK dept.

      What about the mortgage company?

      When we spoke with them ( Chase customer service ) , they said they knew nothing about our b/k, they just keep sending statments. Are you saying that we don't need to contact them at all and let them continue to think we just aren't paying the house until the get notified from our atty??

        I have been trying to work with Chase for over 15 months-before the housing crisis! They are the most uncooperative people on the planet.
        They have a loop on their system that says they are busy, will contact you, call back later, whatever, and you NEVER get a person, EVER.
        I have sent emails, which of course are sent to numerous people and you never get the right department.
        I did finally threaten them with contacting our US Senator (Dick Durbin) which helped and I finally was able to get a number to get thru. I have also used his office (they have a few people for matters like this) and done a 3 way conference call. I got a little accomplished, but still had to jump thru their hoops. But at least I have Durbin's office on my side if I need any assistance.
        We have been requesting a loan modification for 15 months to no avail. They offered us a forbearance for 3 months (standard procedure before a loan mod.) and when that was over we were told to contact them immediately, which we did. That was September 2009. They told us in October that they were 3-6 months behind in processing loan mods, not to contact them, they would contact us. We've heard NOTHING!
        A side note, when it is all said and done, I'd find a small, credit union to do business with. We have and love them! Chase is HORRIBLE and always has been.

          another thought-the reason they don't know anything about your bk is probably because your loan is with one of their other departments. we had to do this too.
          It may be in the 'collections' department, not the same as bk dept. It may also be in another dept. if you've asked for assistance, like HAD (homeowner's assistance dept). And each department has no clue what the other one is doing! It is a HUGE mess and a hassle.
          You probably won't be able to access your account online anymore either. If you still can, print and save ALL of your information. Once we filed, they quit reporting, once they changed their system or we asked for a loan mod, our account disappeared.

            In a community property state ...is a spouses inheritance part of a chapter 7 filing?

              I wonder if the statements a kind of violation of the automatic stay. (Assuming you didn't reaffirm.)

                Yes, the statements are a violation if the debt was discharged.

                I highly suggest the poster (pattygg) contacts their BK attorney to see how to proceed. Also, ask Customer Service for the FAX number for the BK Department and send them a faxed letter demanding that they stop violating the discharge injunction, or you will file with the Court for a contempt violation and for sanctions.

                Seriously though, your BK attorney is the first place to go.

                  Contact Chase's executive departments at the following numbers:
                  1800CHASE99(General Chase Executive department)
                  18008489117(Chase Home Finance Executive Department in Columbus OH) Hopefully they will help you. I was getting the runaround until I finally got to these people. Hope this helps!
