Who can attend 341 meeting?

...last (strange) question for the night; I pulled an all-nighter again and had a few things i couldn't figure out from the literature/internet. ;)

I am preparing the paperwork on behalf of my father and not retaining a lawyer. Could I attend the 341 with him? Advisable? I'll review all the paperwork with him and the prepatory questions from NOLO, but I'd like to be there is the event something comes up for which he is unprepared.

Only, I lied...ONE more dumb question I just thought of: If I can attend, do I (should I) wear a suit?

I don't see why you can't go with your father. If I was concerned that he might not fully understand something, I would certainly be there. Be prepared to be asked why you are there. Since you are not an attorney, or his legal guardian--if you aren't--you may not be permitted to say anything. Now, having typed that, if you don't have a Durable Family Power of Attorney, for your father, get one and then you will be able to assist.

As far as attire goes, 'business casual' will be fine. That is usually considered to be a nice pair of slacks and a pullover shirt such as a polo shirt with collar. Though as others have stated the attire can run the gamut from expensive designer to cut-offs and flip-flops.

You may draw up a Durable Power of Attorney for your Father. It must be witnessed and notarized but you can find the forms on the Internet. I see no reason once there, to ask the Trustee if you may aid your Dad. How old is he? Does he have any physical or mental age related disability that you would suspect he would need help (early dementia, etc.)? If so you do have a legal right to help him. Now it is his bk so he is pro se. You are not a legal representative (as in a bar lawyer) and cannot legally advise him, but, you can fill out his forms for and with him as long as he can attest that he has read and understands them. The P.O.A. protects you as well as he. It would release you from any doubt by the Court. 'Hub
