    Utah Means Test?

    Does anyone know if for the means test calculation in Utah County, Utah if they use Schedule I & J, or just the numbers off the 22a?

    The Means Test is Schedule 22A. However, you also have to fill in your income and expenses in Schedules I and J. Schedule 22A is a "look back" over the last 6 months, and Schedules I and J are current and future income and expenses.

      On legalconsumer.com it says some courts use I&J to come up with a different DMI, that would imply not all. Trying to figure out if this specific one does or if they strickly stick with the IRS numbers.

        Gosh, there are more rules than carter has little liver pills! I wish Central District in California only went by the Means Test, because I make so little money, I didn't even have to take the darned thing!

          You're right - the courts do vary whether they put more emphasis on the Means Test or Schedule I minus J across the country. The only way to find out which *your* local court uses is to ask experienced bk lawyers in your area.

          Have you set up 3-4 free initial consultations with experienced bk lawyers in your area yet? Now is a great time to do that.

            Haven't done any consultations yet. Within the next several weeks I hope to get the ball rolling. I need my tax return money for the fees.

              Not sure on Utah County but since we are in the same state, a county apart (on the other side of Point of the Mountain) and that lies in the 10th Circuit I know in our case they used B22a to identify if the UST would get involved in our case and schedules I & J to determine if they wanted to file to dismiss or convert the case. The schedules I & J were used in our case for the UST to determine our DMI moving forward since the UST filed in our case for a Motion to Dismiss (or Convert). The spreadsheet their CPA used was based entirely on our schedule I & J. Hope that helps.
