checking account and direct deposit question... again

    #2
I've never heard of anything wrong about getting another checking account after filing, if they'll let you. It's obtaining new credit that's the problem, not that I fully understand the story -- what the consequences can be of doing so.

While you're hunting for information, a useful phrase for your (2) is "set off".

It is best to have a separate bank for your deposit accounts, that way you never need to worry about amounts being set off.

That said, once you filed BK you are protected by the automatic stay, so it is unlikely that Chase will try to take your bank account. Even if they were contractually entitled to a set off against your bank account they would have to apply for relief from the automatic stay to take the money. The automatic stay is taken very seriously and if they violated it they would be in a lot of trouble.

I have my paycheck direct deposited at BofA and filed against them on a CC and had no problems... was also able to open a high yield savings account with debit card with no issues and they pulled a CR! You shouldn't have a problem, a co-worked filed and had Wells Fargo with direct deposit and also has no issues or a froze account, like many on this board have reported.

I actually called Wells Fargo today to see if my checking account had been frozen due to BK. The guy on the phone said no, so I went on to tell him how many bad things I had heard about Wells freezing people's accounts - even when they had no credit cards open. He was really offended! He said his own sister had filed Chapter 7 and he had reassured her - and wanted to assure me - that Wells Fargo would NEVER do such a thing, and I had them standing firmly behind me... Well, after I put the shovel away, I thanked him and said I would be depositing my next unemployment check back in my account. LOL! Banks...
