    How long to move out after discharge?

    Hi All,

    Can I please get some feedback/ballpark estimates on how long it might take the bank to move me out of my home after my Chapter 7 bankruptcy is discharged?

    It all depends on your state foreclosure laws. I don't see what state you live in. Do a search for (your state) foreclosure laws. It will tell you the typical timeline for foreclosure. I live in Oregon. It says typically 180 days. Here they have to give you 120 day notice that they are auctioning it off.
    9/30/09 * Filed Ch7
    11/9/09 * 341 - Uneventful
    1/11/10 * Closed

      Check with your BK attorney to find out what the *new* timeline is in today's market. I say that because here in S Fl if you look at the statutes you see a 6 mth timeline and the actual is closer to 2 yrs for the entire process. Not because the paperwork has changed, but because the lenders are dragging their feet when it comes to actually selling the property. My BK attorney said don't move until the final judgment and sale. So far I'm still here and I was discharged a yr ago. You might have more time than you think.

        I'm in Idaho. It looks like it's supposed to be a 150 day process - http://www.foreclosurelaw.org/Idaho_Foreclosure_Law.htm. I've asked my attorney, and he said to move out "when they tell me to." Not very helpful. Thank you so much for the feedback!
