    Question about job after filing

    My employer who let me go back in September of '09 has asked if i wanted my job back...They are starting to get busy and offered me my job back WITH commission. I am currently in the process of a Chapter 7. I filed in November and had My 341 about a month ago in mid December. THe trustee asked for a continuation of the 341 ( he wanted to see some HUD statements)...Is it okay to take this job ? Is there any way they can put me into a Chapter 13 if my salary increases and i start putting some money into a savings account?

    It may not impact your case, but some Trustees/USTs get weird and try to convert your case. Just remember, you don't actually have a job until you actually start it. In order to avoid any uneasiness in answering the question "has your financial status or job changed since filing"... many people wait to start their "new" job after the 341 Meeting. Technically, your Chapter 7 is based on your financial picture at the time you filed, not after. However, you want to avoid any "totality of circumstances" challenges from the UST.

      My 341 hearing was over a month ago....but it was continued until the end of this month...because the trustee wanted more paperwork. Should i wait until after this date?

        I can't tell you what you should do. The decision will be yours on when you start. Since the month is over in a couple of weeks anyway, can you wait to start February 1st? It will be you who may have to answer the Trustee's question. Then again, since your meeting was continued for just the HUD paperwork, you may not even need to answer that question. Was it asked at your first 341 Meeting?

              i was unemployed when i filed and at my 341 i was asked if i had found work yet and my answer was NO..because i wasnt employed at the time...i wass still on unemployment...

                Exactly, and if, at the continued 341 Meeting, you are asked the question again? That's my only concern. I'm sure you can delay starting for another couple of weeks if your old job loves you that much.
