    More asset questions

Since we're under the median, we're going to push for a ch7 filing rather than a 13. According to our attorney, we have up to about $10,000 in non-exempt assets. I know what most of them are, but he didn't give us a complete list. So, two questions:

    1. Is a riding lawn mower non-exempt or does it fall under our household exemption?

    2. We are considering having to sell some assets in order to pay the extra attorney's fee for the 7. We also will owe income taxes this year and we have a child that needs braces. Can we use the money for all of those things prior to filing? Also - hubby thinks that he will post the items for sale at his work - there's no problem with selling them to someone he works with as long as it's fair market value, correct? How do we handle the paper trail - do we print up a receipt and then make sure we deposit that money in our checking account?

Thank you so much for any help you can offer!

Can we use the money for all of those things prior to filing? Yes you can as long as they are accounted for and an exempt asset. Also - hubby thinks that he will post the items for sale at his work - there's no problem with selling them to someone he works with as long as it's fair market value, correct? Yes. How do we handle the paper trail - do we print up a receipt and then make sure we deposit that money in our checking account? Yes, and list whom you sold it to.

You don't have a problem with what you have stated.

Here is an address for exemptions. I don't know your state.

Bankruptcy exemptions determine if you can keep your house, car, pension and retirement funds. Learn the available state and federal bankruptcy exemptions.
