Actually I meant to say I "wouldn't" pay anything to stop the foreclosure. I'd just try to settle. Making payments to stop foreclosure would be a waste in my IMO. Because if you don't settle you don't get that money back. I don't see why you couldn't get a loan mod? The whole point of a loan mod is to keep you in the house so the bank keeps making money. Now if you have no income or job then I see your point.

As for rental properties and trustees....I don't know. I just know some districts scrutinize rental properties. If your attorney thinks you can negotiate then go for it.
