    New to all of this.

    My husband and I should be filing for bankruptcy in the near future. We are about 5 months past due on our mortgage as well, and we just got approved for an appartment. Is is stupid of us to get an apartment BEFORE we file and/or foreclose? I'm asking because we should be forclosing sometime soon, we're just trying to file before it happens. So we'll need a place to live, obviously.

      No, I don't want to keep the house, that's why we are getting an apartment. I just want to know if I we should live with someone else before we do anything that would reflect on our credit.

      I heard that if you get another house are place to live (or anything for that matter) before you forclose or file chapter 7 it shows on your credit and looks bad.

        I guess what I'm trying to say is... Should we just lay low, and not do ANYTHING before we file? I mean we need a place to stay, and I'd rather not live with the inlaws.

          Stay in your house as long as you can. Filing should delay the foreclosure and give you time to build up a savings after you file. Do you know if you are in a judical for non judicial state for foreclosure? Do you know how long it is taking for forecosures in your state now? Ask your attorney for details.

            Thanks, that's what I was wondering.

            And I'm not sure about the other questions you've asked. I should be talking to an attorney sometime this week.
