    Want to file a 7, but not sure when ?

    I have stopped paying my bills for months now, mortgage included. When my unemployment benifits run out in mid March I plan on filing ...maybe.

    I have some concerns...

    1. Do I need to rent a place in order to have a house allowence ? ..I don't want the house I have now. And if so, how many months should I have the place before filing ?

    2. When my unemployment checks end , and I have zero income ..will the lawyer still need to look back and figure an average income for me ? ...even though I have no income ?

    While I don't know the answer to question one, the answer to question two is yes. Regardless if you are currently have an income or not, your attorney will still have to go back to figure out an average income for the past 6 months.

    Why are you so sure that you won't have an income in two months? Are you currently looking for a job? Even if you can't find a full time job, what about several part time jobs? Just remember, BK will wipe out current debt. It will not fix an income problem. You will still need money for living expenses.

      The lookback period is 6 months backward from the date you file, so if you file before 6 months have passed w/o your UC, that will have to be figured in.

      Forgive me for asking, but how are you going to live w/o an income?

        As far as income...my wife is working, we just don't qualify for a 7 with my checks.

        Why would they look back 6 months and figure an income for someone that has ZERO income ?

        I understand if they figure for my wife. But when they figure that I have a income and I don't ...it gives and disposable income number that is a made up fantasy ...complete make believe.

        With a straight face they will tell me I have a income when I don't ? ...

          there's a six month look back that is used for the means test, and schedules I&J use future/current income. So commonly- most people have 2-3 different income amounts in their petitions because of changes in circumstance like yours.

            If I have 3 different income levels in my petition, based on past current and future ...what number would the disposable income number be calculated with ?

              the income levels in schedules I&J. That is the figure for income you are making after filing.

                Why wait until your unemployment runs out? Unemployment even at maximum amount is not very much. To have no income at all seems strange. Perhaps it's just me..

                  My wife has income , about $1800.00 every 2 weeks and MY checks are $660.00 every 2 weeks.

                  It is making the difference between a 7 and a 13
