Who Pays My Rent After I File Ch. 7

The Trustee (who now 'owns' my assets) or me? Same for utilities, phone, etc. Can I continue paying these accounts, or do they pay for me (or do I need to get permission to pay certain accounts)? Thanks.

Also, I have a storage unit. Can I continue to pay for that as well?

I was wondering too if the storage unit is considered a 'secured debt'. The way the contract reads, they have dibs on the goods if I fail to pay. That fits the defnition I read of what a secured debt it. They will place a lien on my goods if I fall behind by 2 weeks or something like that. I always wondered how that would be handled in a BK proceeding. The storage holds household goods.

    Hi,

I'm assuming you have filed and had your 341 meeting at this point based on your post?? Are you an "asset" case or what is the status? We need a little more info on your situation. Your utilities are not "assets" so you need to continue to pay those if you want to keep your heat and lights on. Your phone also needs to be paid by you if you intend on keeping it. Same with cable tv, internet, car insurance...those items you can continue to pay as normal.

      You continue paying routine bills.

Debts you are seeking to retire with the bankruptcy you would not pay like credit cards, medical debt etc. But utilities, rent, etc you still have to pay.

JRScott is right, if you are keeping the service or utility, you pay for it when due. You may want to contact the utility or the creditor on the items that you will keep to see if they have a different procedure for your payments during the BK process before your discharge. For example, I paid Verizon and had to make the payments directly to the BK dept over the phone. After my discharge, the payment process reverted to the normal way online. Each creditor is different in how they handle payments during your BK.

My atty has told me the day after I file, I can put money I come into possession of in the way of gifts or earnings ot lottery winnings into my bank acct, savings acct etc, and pay my bills with it period. It is not part of the CH7 BK process or BK estate. Pay your rent and bills or you will be homeless on the street, and I can assure you you will not garner any sympathy from your government, TT, lawyer, etc. Take care of yourself and family. Any inheritance or life insurance for 180 days after filing goes to the TT however.
