    Chapter 7 & Surrender of Vehicle

    Hello,
    I'm sorry if this is a re-post I tried searching and did not find anything....

    Filed Chapter 7 in may, was discharged in August of this year Located in MN.
    Agreed to surrender a vehicle which needed some repairs, in the filing.

    After the Creditors meeting, the Lender contacted my Attorney, who then sent us a letter stating that the Lender's usually way to handle this is to wait for the discharge, then contact Our attorney to arrange the surrender. and if we waited the car gone sooner he could contact them and set it up. From the filing it's a care worth about $1,000and we had a pay off of like $7000 on it (when you add interest,fees,etc)

    Now, It's coming up the End of 2009 and we have still heard nothing from this lender. is there a length of time they have to contact us? The car has been sitting with comp only insurance on it, can i at least pull that? Our lease will be up soon, and i don't want to deal with moving the car if i don't have to, but I would be very happy to move it if they are not going to take it....

    Does anyone have any experience with this type of thing?

    No experience but a suggestion. Send them a certified letter stating that either they remove it, or send you a clear Title. They just may have abandoned it. If you do not get a response in a reasonable time (30 days) send another letter that you are going to charge them insurance coverage from your date of discharge and storage fees of $60 a month. If they do not respond then, sell it to a scrap metal place (no Title required in my state FL) for salvage. Give them another 30 days. Just my 2 cents. 'Hub BTW Merry Christmas
