Workers comp settlement and chap 7

I am planning on filing chapter 7 without my spouse. He had to file bankruptcy in the fall of 2008. He's been off work due to an injury. Then got laid off earlier this year. I think his workers comp stuff may be settled soon. Will the trustee go after his settlement if I'm the one filing and not him?

not sure but if they settlement comes before filing it might count as income for him which you'd have to show on your means test and could complicate the thing. You'd need to ask a lawyer about that though.
