DISCHARGED 9/21/2009, but an asset Chapter 7 and not yet closed.....My lawyer just emailed me and said the Trustee wanted copies of my May and June 2009 IRA statements. The bank does not furnish monthly statements but , I had furnished a montly record from the bank showing interest earned and balances for all of 2009, through July 2009. PER MY LAWYER"S INSTRUCTIONS that it was okay, I withdrew $65,000 from my IRA to pay off my HELOC so I could get a reverse mortgage. I did this earlier this month, we just closed recently. I have kept the email telling me it was okay to use the funds anytime. Am waiting to hear back from him as to what is going on! All the assets (vehicles) have now been sold and I suppose the Trustee is doing the final paperwork.. Should I be concerned????? I would think the Trustee would want statements to date, Dec 2009 if there were a problem. What do you learned folks think of this?

Keep that email, it is Gold.
I don't think you have a problem. I would never approve of stealing your future for a payment, but that is not the issue.
He may just be CYA in that you did this for one debt but would not for all those wonderful CC's.
Until further happens, you should not invent a problem. You move a large amount of funds soon after your discharge, that only flagged him. That is all. 'HubIf I knew it all, would I be here?? Hang in there = Retained attorney 8-06, Filed 12-28-07, Discharge 8-13-08, Finally CLOSED 11-3-09, 3-31-10 AP Dismissed, Informed by incompetent lawyer of CLOSED status, October 14, 2010.

Hi
I don't think she (the Trustee) knows about the withdrawal. And she is asking for statements just through last June. I think the lawyer neglected to supply the retirement statements that are proof of IRAS when requested (and supplied) in August. . By the way, I am 68 and with a reverse mortgage can live in my home until I die with no payments. My social security more than covers all costs of living, plus "surprises" like household maintainence, auto repair, etc. The purpose of my IRA savings were always to provide me with cost free housing. This may notbe reasonable for some, but that was my plan as I am not able to work for medical reasons.
Thank you for your input, I appreciate it!!!!! :-)
