    Reaffirmation hearing today

    This is my first post and I just wanted to say thank you for this forum and to all the posters for all the valuable information. To go through this stressful period of our life, this forum has been a blessing.

    I wanted to share our experience at our automobile's Reaffirmation Hearing today. We are in the Central District of California. When we arrived at the courtroom, we had to check in first at a spot outside of the courtroom doors. We then stood there outside the courtroom doors/hallway waiting to be called with a whole lot of other people. They called our name after about an hour and since we didn't have a lawyer with us they had volunteer lawyers that talked to you for a couple mins before you went into the courtroom. In the courtroom, there were about 8-10 seats at a u-shape table with microphones on the table, you are facing the judge. The judge asked us our name and what is our intention - we said we want to reaffirm. She asked us why - we said we didn't have much time left on our loan (10 mos.), it is a good car and our primary mode of transportation. She asked us if we are current and have always been current - we said yes. She said you're approved. That was it! We saw about 5 other people before us get approved, too.

    We are on day 78.......waiting for that discharge!

    I reaffirmed my car too. My 341 was last week(Dec 7) Do i eventually have to go to a hearing also, or no.

      If you filed pro se you will need to have a hearing before a judge. If you have an attorney they can sign it and you are done. If your attorney refuses to sign you can request a hearing and explain to the judge why you think you should be approved on it.

      To the OP, why did you reaffirm? Seems like with 10 months left you'd have equity and if you were never behind you wouldn't risk a repo? Did your lender threaten to repo without the reaffirmation?

      I reaffirmed because I have lots of equity in the vehicle and my CU agreed to lower the payment from $635 to $400 and skip a payment to get us current, but only if we signed the reaffirmation. It extended our payments by 9 months but gives us breathing room and when my income picks back up we expect to increase the payment to get it paid off early.

        We had to check the Presumption of undue hardship box on our reaffirmation paperwork that we received because we had negative disposable income on our Schedule J and our attorney wouldn't sign off on our paperwork - I hear most attorneys won't - but I think if your attorney signs off on it or if you have a credit union, I don't think you have to attend a hearing, I'm not sure. Maybe someone else with more knowledge could answer this better for you.

          Our lawyer said that we would be contacted (in the mail) for the reaffirmation hearing. That we don't need to contact anyone ourselves. Was that the case for you? About how much notice did you have of the reaffirmation date? We're about 3 weeks past 341 and also central CA district. We haven't heard anything yet.

            We reaffirmed honestly because I was scared not to. Our lawyer was not going to represent us for it and he didn't tell us any other options. He had checked the reaffirm box on our petition. We do have a lot of equity in it and I didn't want to take any chances. We didn't have to reaffirm our mortgage, we're just paying like normal.

            Yes, that what happened for us. We got our reafirmation paperwork from the lender about a month and a half after our 341. We mailed it back to them and a few days later we got the date for the hearing in the mail and it was scheduled for the next month.

              Thanks. I'll keep my eye out. Our vehicles are almost paid off, but we want to reaffirm and draw out paying them off so that we can build up some credit.
