    Another discharge

    Yay! So much prep this year in dealing with the BK! Finally discharged today!

    Although, a few things still of interest:

    - T asked for 2009 Returns

    Still on the hook for this since T verbally told us to send them our 2009 Returns. We expect some money back. My atty said they'll get 2/3's of my return since we filed in Sept 2009. I guess a small price to pay to be discharged of our debt. Without even doing our taxes and guessing, expecting maybe $1 or $2k back? /shrug. Just lived off unemployment and wife's small income.

    - T employ atty

    Case still shows "No Asset" in pacer but T hired an atty back in Oct. Still no word on my stocks since they are of no value still pending court case between big corps.. my personal estimated value if I receive anything from that is probably $200... maybe $500 if the company wins big (/shrug)

    - HOA was included in BK?

    So, listed in the discharge list is our HOA. I find that rather odd. Since we're doing ride-thru, we want to stay here for who knows how long, so I guess we still need to pay the HOA. I didn't even know HOA fees could be discharged.


    Well, besides all that, fresh start sounds very good

      CONGRATULATIONS!!!! This is a great way to start a Tuesday! Here is one for you:








      On the HOA fees, I have heard of them being discharged. You are perfectly free to pay any discharged debt you wish to. You are not now legally obligated to do so, and if they attempt 'strong-arm' tactics to make you pay, they are violating the law and you can go after them.

      I had a medical bill that I wanted to pay and had planned to pay down a few dollars at a time as I could. But the provider became hard-nosed and sent the account to collections and other tactics, that I sent a cease and desist letter with a copy of the Discharge Order with their names on the mailing matrix, and a copy of the law they were violating, and sent the whole thing by certified mail with return receipt. So far they have been silent; this was almost a year ago.

      NOTE: I had NOT yet started making any type of payments to them before they started all this stuff.

        I did not even know the HOA fees were going to be discharged. I was planning to continue paying them as long as we continue to live there. I'm sure they can force a lien on the home if they are not paid (but it's discharged?). That part is confusing but no biggie since I will keep paying it.

              Congrats. Now all the fees that were owed up to the point of discharge (Today) are not collectible by your HOA. However, I assuming you are keeping the house, then the fees from here on will be accountable for. It is billing received after your bk so it is yours to pay. The past due should be wiped out and I would address this with your association bookkeeper now so that there is NO future problems and that the new charges and old charges will not become commingled.                 Thanks. Yeah, I did some reading, and I basically need to keep paying (which was my intention anyways). I never had any past due HOA fees anyways because I was always afraid to not pay them.

                The HOA might be worse than the IRS! :P If you don't pay, they try to do bad things to you.
