    Went to Pacer...

    I am on day 60, the last day for objections being December 14th. I went to PACER as I swore I would not, and I see I am listed as an asset case awaiting discharge.

    Now, I own nothing except my very exempt car (it is worth $1000.00, no kidding!). I assume I am listed as an "asset" case because I paid $990.00 to one creditor in the 90 days prior to filing by BK. We knew about that at the 341, and I have heard of absolutely nothing else.

    At the time of the 341, the attorney said to expect the discharge in 90 days, so that would be mid-January.

    I could call and ask this very likely obvious, nothing to worry about question, but I am sure I would get a Secretary who would act as though it was a privilige to speak to a paralegal (forget the attorney!), so I would rather just skip it and wait.

    I do hate this though!

    I checked mine and it still says "Awaiting discharge" no asset case and my 60th day is today too. I was watching your posts to see how you did. My district is buried with bk cases, and I did some research and found out that the cases are being discharged about 2-3 later than normal right now.
    I am not sure if you had a lawyer, Leena. I didn't go back to read earlier posts, sorry.
    But, why can't you just ask your lawyer tomorrow? You paid him for this. I sure hope the Trustee backs away like I've heard they do lots of times.

      Yes, I have a lawyer. This would really not be a situation where I am thinking the trustee is "after" me. I think they decided to go after the creditor I paid the 990 to within 90 days of filing. That is on the credit, not me, They take that money from the creditor and redistribute it among all the creditors, but technically it still makes me an "asset" case. Like I said, we knew about it even before the 341. I just hope it does not hold up the discharge.

        It could be your next year's tax return as well. Often a case is made an asset case in anticipation of a tax return.

          Leena, it sounds like you got a handle on all this. I hope it doesn't drag out for ya.

            Nope, no tax return backtoschool, I will owe taxes due to cashing out my Health Saving Account to pay for the BK, and I sure can prove it on my returns!

            No other assets either, and no other flags on the case so I pretty much know it is about the $990.00 paid during the 90 days before filing to one creditor. As I said, it was discussed at the 341.

            I also saw two creditors filed claims - as they are told to do when there is an asset in a case. One was student loans, which is downright funny because I was not in default with them and they will be getting my money for the next 20 years! The other was Asset Acceptance, a collection agency. So, it looks so far like that $990.00 will be leaving Merseli and Kramer and moving on over to Student Loans and Asset Acceptance.

            Thanks Michigan, I hope this does not hold up the discharge too much, too! I hear it really does not, they just need the trustees report of the asset (s) and they discharge anyway, then close after the assets are distributed.
