    Money in the bank at filing day

    In filing day, does your checking account have to be zero balance? I'm suppose to file this week which I have zero balance right now but something came up I have to file next week but the problem my salary of 2K will show up this Friday 12/18/09, after paying some utilities I will have about 1200 left, will this cause a problem? Thanks in advanced.

    It all depends on where you are located..Here in AZ we can protect one account in the amount of $150.00 or $300 if your married. They really want you to be broke in AZ..LOL I just had my payroll switched to a paper check before I filed and plan on changing it back after my 341 meeting in January. Hope this helps!

      We are in Florida Middle District (Jacksonville). We were told to have our checking account as close to zero as possible. *Heh*, that wasn't a problem as we were in an overdraft situation so had a negative balance. We were told that on the day we filed, that would be a snapshot of our financial situation. We weren't really given a good explanation why.

        Make sure that whatever cash you have in the account on the filing date is listed as exempt in your petition. That is why you have to coordinate with your attorney as to the exact amounts in your bank accounts.

            You have very generous exemptions in CA. Which system are you using, System 1 or System 2? Look at your exemptions here: www.legalconsumer.com

              We had about $1500 in (2) bank accounts when we filed and DH was paid the day before the 341 ($3500). No one said anything about our bank funds.

                Same in Colorado. The night before I filed, I had a little more than that so I did some grocery shopping....that did the trick.
