    Car before discharge

    I had to file chapter 7 and had my meeting on November 9th. I had to file because I had a house that was on the market over 5 years, had a buyer Sept 08, and the buyer backed out last minute after I had borrowed 25k that would not cover what was offered. So then got stuck paying the 25k (I borrowed from a famlily member-so paying them) and stuck with the mortgage and I had already completely moved out. So bascially after unable to sell it, and the bank was not working with me. The only thing that went thru the bancruptcy was the house. I reaffirmed my car loan. Now I am having issues with the weather and the type of car I drive. I have had to miss work because of the snow (I have a Smart car--which is not too smart for a car in Maine) I had purchased the car right before the woman back out, and it was not my plan to live 30 miles from my job. So I need something more sensible. I was just approved with my Mother cosigning with me for a loan, not thinking if my bancruptcy will get screwed up?
    I am supposed to get the car Saturday....should I hold off (but I cant miss more work)? Will the fact my mother will be a signer then be OK, because she has claim to it?

    I am in a similar situation in that I planned to reaffirm but am now thinking I will surrender my car prior to discharge. My only concern is like your's, can I apply for another auto loan prior to discharge with my mother as the cosigner without fudging up my discharge? When am I technically allowed to get an auto loan again? I just don't want to be forced into a ch. 13 after my 341 went so well today.

      It's probably fine, but you have to get permission from the trustee before you take on any new debt before you are discharged. Just tell him/her your situation and I'm sure they will approve it.

        If you've not been discharged, you better formally cancel that reaffirmation agreement.
