    Relief of Automatic Stay Granted... What's Next?

    I'm in chapter 7. I plan to surrender my vehicle. Just found out that the relief of automatic stay was granted. How long before they come for my vehicle? Do they have to contact me first? Should I contact the bank? I just need time to make arrangements for a new vehicle. What kind of timeframe am I working with here?

    We really can't tell you what the timeframe is. Some lenders are pretty prompt (within a week or two of receiving the relief) and some will actually wait until the case is closed before proceeding.

    If you want to make arrangements and speed it up, you could contact them and see if they're willing. If it's a credit union, you may be able to drop it off at a branch. Again, you'd have to contact them.

    Generally speaking, you'll be contacted by them or their repossession agent when they are ready to get the vehicle.

    In the end, you should expect to have the car repossessed tomorrow. Plan for this. Make sure all your personal stuff is out of the vehicle. When the repossession actually happens is anyone's guess.

      I wonder what the experience has been with Citifinancial Auto concerning this matter?

        It is so dependent on your State and your case, that it's still difficult to speculate. Since the relief was granted, you should expect and plan to lose the car today. To me, it reads as though you were expecting to keep the car for a while. You may be able too, and perhaps someone from your State can tell you how Citifinancial Auto is performing repossessions there.

        Citifinancial Auto just doesn't come up too often as a lender on here. (It has, but just not as often as the Big 3 and larger banks.)
