Stop Paying Unsecure -with Assets

Hi,

I have chase calling me now about my late credit card payments - I do own one car outright which I plan on seeing if I can buy back from the trustee once I file. Do you think I can hold off until filing in Feb/March? I want to use my tax refund to pay my bk filing fees and property tax and am filing married as a single debtor. My wife will not be filing.

I have no money now, the buyback of the vehicle is just to mention an assets exist that if I am employed at the time of the meeting of the creditors I can work out a payment plan.

How long since you last paid? You probably have at least 6 months before Chase starts anything legal.
