Saturday is "auction day" for my home.......

    Minnie, glad to know you are still in one piece but I think we all knew you would be no matter what, you must be made of steel woman!

    I think I would have had to take a broom after those turds snooping around in your home. I am soooooo glad you let the bidders know what needed to be fixed.. sounds like your good ole Trustee got his panties in a wad about your comments, I did have to chuckle at that.

    You will have your day in court over this, I'd say a lot of pain and suffering needs to be redirected back to the ones that caused all this.

      Its another day, I slept a lot better last nite, and hopefully today I will get the papers back to my home.........
      I'm still worried a little because it stripped me if every dime I had to get my home back, but it's worth it. I will recoup and have a backup again soon for emergencies.
      Friends helped make up the difference (bless them) to keep me from loosing it completely...
      Today is a new day, the sun shines a little brighter, and its time to start fighting for what is "right"!!!!
      Needless to say, lots of things have come back to my ears since the auction Saturday......
      The Trustee got into a conversation with a friend of mine - he thought her husband was bidding for it.... he didn't know we were friends... The Trustee told my friend and her husband that this auction should never be taking place... that I had been "screwed" by my attorney from day one, and he made no attempts to negotiate with him, and not attempts to work the situation out.... STRAIGHT from the TRUSTEE'S MOUTH.... The Trustee said the title company and mortgage company were responsible for all the errors they made.... but the main responsiblity lay on my attorney............ for not working on my behalf at all.... I said he was "covering his own" butt all along.....
      Lots of people were "my ears" Saturday...... lots of comments made......
      So today, I'll sign the papers, get my home back, and then start the process of going after my attorney FIRST, then the title company and mortgage company for their actions in this.
      I have no real hard feelings towards the Trustee, though I do feel like he did step over the line in a few areas. We will be checking theses out too. Seizing and selling property that WAS NOT IN MY NAME, selling property at the auction that WAS NOT IN THE PETITION FOR AUCTION..... and discussing my entire case with another Trustee, WHO IN TURN discussed it with one of his clients (who filed BK - who just happens to be someone I work with everyday) DUH.......word travels quickly sometimes....

      So NOW who can I help...... who else has title problems or attorney problems.......

      I've really learned the loopholes thru my bankruptcy and the problems that can arise unexpectedly.... I have also learned what "my rights were SUPPOSED to be" and the limitations and restrictions Trustees MUST FOLLOW.....
      very interesting............ ALSO learned a lot about what my attorney SHOULD HAVE DONE..... The Trustee talked to my friend about WHAT MY ATTORNEY COULD HAVE DONE, to prevent that auction from taking place - but my attorney didn't.....
      The auctioneer felt so bad for me, he made it perfectly clear he didn't like doing it..
      Even the Trustee's wife made a comment to my friend, "this is sad - this should never have happened to her!"

      So now, its on to me helping someone else on this forum - if I can...... I'll try not to suggest anything I'm not sure of to anyone.....

      But I do hope my experience helped open all "your eyes" as to what can actually happen really quick in a bankruptcy.... and especially if you have an attorney who takes care of himself - instead of you - trying to cover up his own mistakes....

      Yes, there's a smile back on my face today, but it's a weak one.... tomorrow will be better after I get those papers signed today.....

      I will keep you informed of negotiations with my NEW ATTORNEY - on making all these people pay for their errors, and the financial loss and problems they have caused me over the last 18 months.

      THE STRONG SURVIVE - AND I AM A SURVIVOR........
      My friends said I handled the auction real well, stood up to the Trustee for my rights and told him so....
      And now my "tight jawed determination" to "get even".... is BACK AND ALIVE AND WELL.....

        Don't fret, Minnie. Let all of that stress roll off of your shoulders and enjoy your home, which someone else will ultimately be paying for.
        Before long, you'll be as happy as a live turkey on the day after Thanksgiving! Art

            SIGNED - SEALED - DELIVERED - BACK TO MY HANDS AND CONTROL..................

            18 Months of pure Hell is over, except for the clean-up (hehehe).......

            Such a relief off my shoulders to know all this is over except going after these dudes for my problems they created for me.....

            They are lucky I was able to buy back from the contractor, but that's okay..... at least I will stay in my home.

            Now I can "think" about having a decent Christmas with friends...... No gifts this year - but I will cook them a kettle of soup beans and fried cornbread and wish them all well.............

            Talking to attorneys today about what we can do to these people for their STUPIDITY.......... and all the grief they have caused me for 18 months....

            I'm not a person that "sues", but in this case - I WILL......
            and let them pay my home off, if possible for their STUPIDITY.........

            I thank God that I was in a postion after the auction to buy it back from strangers......

            Course they made a "quick buck", but I can live with that..... at least I don't have to give up all I've worked for and move in the middle of winter - 21 degrees outside this morning..... high of 30......


            Okay, now to YOUR ALL'S PROBLEMS - mine have dissolved themselves for a while......

              I'm proud of your for your strength and determination. You are a courageous woman and I'm glad I have had the pleasure of meeting you on this forum. It sounds to me that most of your case has already been won. I'm so glad you were able to reclaim your home. Good Luck sticking it to that ambulance chaser, the title company and others. You are truly blessed. Have a joyous holiday.

                Fried cornbread. Yum. No collard or mustard greens to go with that pot? You fixin pintos or red beans? My mom was born in Kentucky and my dad was from Massachussetts, so I grew up with a strange mix of eats.

                  Our C'mas traditions include Tbones on C'mas eve & turkey dinner on C'mas day. We used to eat at my in-laws on C'mas eve, but now that we have 3 kids we stay home. My MIL sends us Omaha steaks each year. And, we have C'mas dinner at their house-we usually bring a dish.

                  Sometimes I feel bad that the 5 of us are descinding on them, but it occurred to me at T'giving that if we DIDN'T go to their house, it would just be my mother & father in law, and my sister in law. (Dh's sister is newly single, and his brother has permanently moved out of state now that he's out of college. He's working, won't be able to come home for C'mas.) It occurred to me that perhaps they enjoy having us, and their only grandkids, over and that I shouldn't feel guilty!

                  How much do I owe for this therapy session?

                        Thanks Nature - this year will be A LOT BETTER than last year was - for sure......cause they had seized my home last year a this time..

                            Take regular cornbread mix (like for pan or skillet) drop in hot grease in skillet and make corn fritters. Better than regular cornbread to me..... LOVE IT..... so do my neighbors, lol......

                                I guess I just don't understand the south. I moved to north florida over a year ago, and still don't understand some of the things they sell in grocery stores here. Ham hocks? Dried out turkey? These things are for human or pet consumption? And some black dude was telling me about 'grits'. WTF
