Well the Auction is over and my friends did not get it - bidding went too high......
The men that got it just kept bidding.......... wouldn't quit. It went higher then expected but they still wouldn't quit... so they got it in the end.
Good news is that the men that bought it offered to put it on a land contract for me until I can refinance it.....
I don't like land contracts - but it's my only option.
Friends helped me come up with the rest of the downpayment, told me Merry Christmas.....
So tomorrow evening I get my home back under a land contract temporarily till I can refinance...... best part is payments didn't change any.....
Just had to come up with the downpayment... and I was short..... so friends came to bat for me.....
Wasnt' sure until 4pm today that I was going to be able to get it back......thats one reason I havene't been online.
The main reason I haven't been online is I have been devastated all weekend that my friends didn't get it back.... nerves took one hell of a beating till we worked something out today.....
So, have to buy my house back all over again, course they made instant money off the deal........ but so be it.....
THAT'S OKAY - NOW I'M GONNA SUE A BUNCH OF COMPANIES AND ONE LAWYER - cause I lost it all and had to buy it back.....
I was just lucky in the respect that these men weren't buying it for themselves or one of their children to live in.....
They buy and resell every day.......

Saturday was one of the worst days of my life - I think....
About 50 people piled into my home, snooping here and there, asking questions, etc. They just come in and set down at my dining room table like I was going to fix supper or something.... The piled up on my furniture and then started poking all over the house. A friend of mine kept and eye on them when they headed for the bedrooms, etc. She also answered questions they might have.

The Trustee got mad at me for telling people what had to be repaired. He threatened to stop the auction, make me move, and do the auction later.
Evidently he didn't like the "facts of discloser" of the property being known.
What could I say but "sorry".......people have a right to know what their buying....duh!!!
I also made it known that I was not auctioning off my home willing that the Court had "sezied it" for a bad title, he sure didn't like that at all.

My girls were real good - I pinned them up on the lower deck - told them to bite anyone that steps down there...
I told people my dogs were pinned - be carefull, do not pet......didn't need anyone dog bitten to sue me...

I've had a lot of experiences in my life - but Saturday beat all I've ever seen....these people were like vulcers......waiting for the kill.....................

Some did tell me they felt sorry for me loosing my home.... that was nice of them... Some wouldn't bid after they found out they had seized it....... hoping I would get it back.....

I was hoping my friends would have gotten it back for me..because they would have let me paid whatever they did. These other two made a quick profit off me since I wanted it back......and had to pay their price to get it..... A catch 22 situtation there, pay the freight, you can have it back...

Well, I'm calmer this evening knowing that it's going back in my name and can't wait to refinance and get it out of their name. I don't like land contracts at all..... One day late on a payment - they can throw you out!!! That's how they make their "big bucks" - selling it over and over again.....

Believe me it won't stay in their name long......I'll see to that..... They told me my payments will go directly to the bank, so I will make sure I have ALL RECEIPTS FOR TRANSACTIONS.... and I will make sure my payments are on time with a 6 month backup......in reserve for emergencies.....

It may take me 6 months to turn things around, but I will. Don't like living paycheck to paycheck and the Trustee made sure he left me very little!!!!!

But that's okay, I'll deal with it - I've eat peanutbuttr and jelly before...... till I get my reserve put back...

            I AM A SURVIVOR........

Next step after signing papers is LAW SUIT...........

Now I will be hell-bent on suing the ones that caused this problem for me, and let them pay my home off PLUS.......

Step one was bankrtupcy - (didn't know I was going to get a stupid lawyer)
Step two was auction - now that we have that cleared up.
Step three is to file law suits on 4 parties.....

And my friend who sold me the home/property is going to sue to find out why the Trustee thought he could come in a sell HIS PROPERTY at auction and NOT MINE -(remember it wasn't in my name..- seller still legally owns it....)

Should be interesting in the few months.......

But Folks, I'm okay, got my home back the hard way, and even though my friends didn't get it - God still saw fit for me to be able to buy it back from these other fellas. For that, I'm very thankfull......and count my blessings.

In the future during these law suits - I WILL GET ANSWERS - for all the questions the last 2 years that I couldn't get answers too amd why many of my "rights" was denied. This I want to know.....

Love you all, maybe I'll get a good nights sleep tonight for a change or least a little better...

Tomorrow after the papers are signed again, I will enjoy the moment of knowing my home is my own again....(course as long as I pay for it, lol)....

Now, WHO GOTTA PROBLEM, BESIDES ME?????

            CAN I HELP???

            MINNY

Thanks for all the worry, concern, and good wishes from all of you. WITHOUT YOU - I WOULD HAVE NEVER SURVIVED THE LAST 18 MONTHS.....

God Bless You Minny, I hope, I hope that you can recoup your financial losses tenfold by the time you are finished with those ass holes. Hell hath no fury like a po'd Minny! I am so sorry you had strangers snooping through your house, I don't think I could have stood it. I know for a fact that my poopies would not have been a good little boy and girl!

I wish I had an umpteenth of your fortitude! Despite your awful weekend, you are willing to put your best game face forward and offer your help to those who need it. I admire you. Alot!

You know we are here for you when all hell busts loose!

                Kam,
My first stop is the U.S. Attorney General's office in Washington (whose in charge of Trustees. I'm a business lady so he will understand my letter.......
Then my Congressman - who helped me fight Social Security over my mother's problems - and we WON.... took 2 years - but I won.....
And next the board that governs Attorneys - mines in for a surprise........ major complaint.......
Then MY NEW ATTORNEY in Court will deal with:
My old lawyer and his stupidity and trying to cover his own butt.
The bank who processed the loan
The title Company who did all the paperwork (the idiots - THEIR CLERICAL ERRORS WILL COST THEM)
The Mortgage Company that bought the loan and their lack of knowledge in checking paperwork ( and refusing to help me put the roof back on the house)...Needless to say - I'm after them BIG TIME.......THE IDIOTS......
Their BIGGEST MISTAKE was not selling my land back to me.......

I will not settle out of Court.........I want a jury trial for these dudes..... and I'll get it too.....

May also have a valid reason to drag the Trustee into it too................... There's a clause about a Trustee causing undue "harm" to a debtor to profit himself..... that, duh, just might apply in his case..... we'll see..

                By the way, nice picture..........family??

                Minny

Minny, I am saddened that you got shafted so many ways. Thankfully, you have recourse!

I love that "I can tell them what I want, I didn't agree to this!' Regarding that prick of a trustee..I sure think there's some abuse of power there! Taking property and such without full procedure!

Anyway, please be assured you are in my prayers, thoughts and I am truly hoping you'll cut their jewels off for screwing you over.

Take care, relax and then pick up the legal weapons and open fire!!

The goup loves you and wishes the best as always.

                          Minny,
Raise a huge fuss. I want to hear about your story on CNN.. Go after blood! (Not literally, I think that would hurt your case. )
                          But anyway- Go Get 'Em!

                            Minny,
I glad that Saturday went somewhat in your favor. It is awful what you have been through. My friend bought her house through a land contract and refied, 2 year later. Now she is happy as a clam. Hope you are able to stick it to these jerks who put you through all of this.
                            Take care.

Minny, in my neck of the woods if my dogs bite someone the "property owner" is liable. You should have smeared beef flavored sauce on the vultures that made themselves at home and let the dogs out so they can all sue the "property owner". LOL

I sure hope your lawyer chokes on his Christmas dinner!

Answer: There are skid marks in front of the dead racoon.

Minny, ALL THE BEST & GOD BLESS YOU!!! You taught us what courage is about. I don't know how I could have coped with this situation. Not as good as you, that's for sure.
