    Was just served by BOA. Requests response within 20 days. I am filing in about 40 days. My atty said will write their atty a letter stating that this filing will take place and advised I do nothing more than that at this time. Does anyone know out there if that is a good strategy. I do trust my atty/ Man this all seems crazy. I imagine there will be alot of summons to follow as it gets closer to the filing date. Thanks and happy Thanksgiving. Told my wife not to let all this bother her but it did get her upset. I told her let the lawyers do their thing. They need to make a living also.

    Wow, that sucks! Do you mind sharing what you owed and how late you were?

    We had a BOA card- about 25k - they sent it to collections without even calling. We probably go 2 letters asking us to pay; and the regular billing statements. They were actually probably the least hassle we got.

    We just filed in October, so they never used us. We went about 8 months of non payments..

    As far as the suit goes- you could always file a response basically just asking for more time. It takes quite a while for court cases to finish anyway. They give you 20 days to respond to the suit, then there's typically another 30 days to get the hearing date; then there's a decision made; if they find against you- they typically send out a judgement notice and give 30 days to respond to that. Then there's more time for them to garnish etc. Sounds like you'll have enough time. Good luck!

      Let your lawyer make the decisions. You are paying him good money to do that and let your wife know that he is also paid to worry for you, so stop worrying, let him do it, he's paid to. 'Hub

        Last pymt 150 days.
        Seems strange that the bank themselves is actually broke and held up by taxpayer dollars, and they then go after the people who bank with them. If theyy weren't so greedy I would still be in this nightmare paying them, but when interest went from 12 to 29% then this game was over. No more4 CC or banks for me ever!
